Terms of Use
Welcome! Please read these Terms of Use (“Terms”) carefully because they form a legally binding agreement between you and Sorenson Communications, LLC (“we”, “us” or “our”)
These Terms applies to visitors of the Sorenson Communications, LLC and its affiliates’ websites located at www.sorenson.com, www.captioncall.com, www.signlanguageinteractions.com, their respective subdomains, all websites that link to these Terms (collectively, the “Sites”) and users of our information and technology services accessible through the Sites (the “Services”; together with the Sites, the “Site Services”), and governs the use of the Sites Services. By accessing or using the Sites Services, you automatically agree to comply with these Terms. If you do not agree to these Terms, you should not use the Sites or the Services.
1. Privacy Policy. Your use of the Site Services and the information we collect about you during your visit to the Sites is governed by our Privacy Policy. The Privacy Policy describes how we and our third-party partners collect, use, share and disclose information about you when you visit the Sites or use the Services. By using the Site Services, you are agreeing to our Privacy Policy.
2. Access. Please note that in order to access and use certain Services within the Sites, you must register for an account. To create an account, you must be at least 18 years of age, possess the legal right and ability to enter into a legally binding agreement with us and agree and warrant to use the Sites and Services therein in accordance with these Terms. If you sign up for our Services, you may be asked to sign up to a user agreement governing such Services (“User Agreement”). The User Agreement will govern your use of the Services in addition to these Terms. If there is a conflict between these Terms and the User Agreements, the term of the User Agreement will control.
3. Modifications. At any time, we may modify these Terms by posting the modified language on the Site Services, with or without notice to you. Posted modifications will become effective immediately, and your use of the Sites Services following any such modifications constitutes your agreement to be bound by the Terms as modified. We reserve the right to modify, add, suspend or discontinue any aspect, service, Content or feature of the Sites at any time, with or without notice to you.
4. Content. The Site Services includes text, data, graphics, materials, designs, images, videos or other content (collectively, “Content”) created by us or third parties. The Content is provided for general information purposes only and should not be relied upon for personal, professional, medical, legal, regulatory or other decisions. We do not ensure completeness, timeliness or accuracy of the Content.
5. License and Restrictions. Subject to the restrictions in these Terms, we grant you a limited, personal, nonexclusive, revocable license to access and use the Sites Services and its Content solely for your personal, noncommercial and internal use, and only in a manner that complies with all legal requirements that apply to you or your use of the Site Services and its Content, including these Terms, and provided you do not modify the Site Services, its Content or any copyright or proprietary notices. You will not modify, copy, distribute, mirror, frame, publicly display, publicly perform, reproduce, translate, publish, license, create derivative works of, or transmit the Site Services or Content (in whole or in part) in any way through any medium for distribution, publication or any commercial purpose. You will not use the Site Services in any manner that could damage, disable or impair the Site Services or interfere with the Site Services or any feature of the Site Services or other’s use of the Site Services, including any use that violates any laws, infringes on anyone’s rights or is offensive. Your use of the Sites Services is at our discretion, and we can terminate your use, prohibit you from using the Site Services or take appropriate legal actions at any time.
6. Ownership. We and/or our licensors own all rights, title and interest in and to the Site Services and the Content, including, without limitation, the Sorenson trademarks, logos and icons and the structure, organization and arrangement thereof, which are protected by law, including, but not limited to, copyright, trademark, trade dress and various other intellectual property and unfair competition laws.
7. Links to Other Sites. The Site Services may contain hyperlinks to websites operated by third parties or to materials or information made available by third parties. The placement of such links on the Site Services does not constitute or imply our endorsement of such third parties, the content of their websites, their products or services, or the privacy or security practices of those websites. We are not responsible or liable for (i) any content, products, advertising, information or materials on or available from such websites or resources, (ii) any errors or omissions in those websites or resources, or (iii) any information handling or other business practices of the operators of such websites and resources. You acknowledge and agree that we will not be responsible or liable, directly or indirectly, for any damages or losses caused or alleged to be caused by or in connection with use of or reliance on any linked sites or resources. Your interactions with such third parties will be governed by the third parties’ own terms of services and privacy policies, and any other terms.
8. No Legal or Regulatory Advice. Some Content may include legal or regulatory related information pertaining to you or your business. Such Content is provided for general informational purposes only. We are not providing legal or regulatory advice and no attorney client relationship is created by your use of the Site Services or the Content. You should seek the advice of your attorney or advisor with any questions you may have regarding a law, regulation, or dispute.
9. Compliance with Law. As a condition of your use of the Site Services, you warrant to us that you will not use the Site Services for any purpose that is unlawful, offensive, interferes with the Site Services or any feature therein, infringes anyone’s rights or prohibited by these Terms. You agree to comply with all applicable federal, state and local laws regarding your use of the Site Services and the Content. You acknowledge that your unauthorized use of the Site Services or any Content may violate copyright laws and trademark laws, as well as other regulations and statutes. If you reside outside the United States, you also agree to comply with any local laws applicable to your use of the Sites Services and Content.
10. Submissions and Communication. You agree that any information you submit through the Site Services is accurate and does not include any confidential or sensitive information. By submitting information to us through the Sites Services, you agree that we may use that information in any way, for any purpose, including our own commercial purpose, and that such submitted information becomes our property without any obligation and you are not entitled to any accounting, compensation or reimbursement of any kind from us under any circumstances. When you use the Sites Services or send communications to us through the Site Services, you are communicating with us electronically. You consent to receive electronically any communications related to your use of the Sites Services. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices from us intended for receipt by you will be deemed delivered and effective when sent to the email address you provide to us. By submitting information or otherwise providing us with your name, email address, postal address or phone number, you are agreeing that we or our agents may contact you at that address or number in a manner consistent with the Privacy Policy.
11. Feedback on the Site. The Site Services may have certain features that allow you to submit comments, information, and other materials (collectively, “Feedback”) to us and share such Feedback with other third parties or the public. By submitting Feedback through the Site Services or otherwise providing us with any Feedback through any means, you grant us a perpetual, irrevocable, transferable and sublicensable right and license to access, use, copy, reproduce, process, adapt, publish, transmit, host, display, create derivative works and otherwise exploit that Feedback for any purpose (including in testimonials or our other marketing materials and where required to do so by law or in good faith to comply with legal process). We reserve the right to remove any Feedback posted in public forums on the Site Services, if any, for any reason at our sole discretion.
12. Indemnification. You will indemnify, defend and hold harmless us and other visitors or users of the Site Services, and our and their affiliates, officers, directors, employees, agents, representatives, partners and licensors from and against any and all claims, actions, proceedings, suits, liabilities, damages, settlements, penalties, fines, losses, costs, disbursements or expenses, including attorneys’ fees, arising out of or in any way connected with your access to or use of the Site Services, the Content, your violation of these Terms, your violation of applicable laws and regulations, your violation of any rights of another individual or entity, your negligent or willful misconduct, or any emotional or physical harm to you or any third party resulting from your access to or use of the Site Services or Content.
13. Disclaimer. The Site Services and the Content contained in the Site Services may include inaccuracies or typographical or other errors. WE, OUR AFFILIATES AND OUR RESPECTIVE SUPPLIERS, LICENSORS, EMPLOYEES, AGENTS AND REPRESENTATIVES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, CONTENT, SERVICES AND RELATED TEXTS AND GRAPHICS CONTAINED ON THE SITE SERVICES. ALL SUCH INFORMATION, THE SITE SERVICES AND THE CONTENT ON THE SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND. 14. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, UNDER NO CIRCUMSTANCES WILL WE, OUR AFFILIATES, OR OUR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS AND LICENSORS (“SORENSON PARTIES”) BE LIABLE OR RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LOSS OF GOODWILL, LOSS OF INFORMATION, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, WHETHER BASED ON CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY OR UNDER ANY OTHER THEORY OF LIABILITY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITES OR SERVICES, YOUR USE OF THE SITE SERVICES OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE SERVICES, CONTENT AND/OR THESE TERMS IS TO DISCONTINUE YOUR USE OF THE SITE SERVICES. IN THE CASE OF A JURISDICTION THAT RESTRICTS LIMITATION CLAUSES, THIS LIMITATION WILL BE APPLIED TO THE GREATEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS IS INTENDED TO LIMIT ANY RIGHTS YOU MAY HAVE THAT MAY NOT BE LAWFULLY TERMINATED.
15. Governing Law; Jurisdictions; Disputes; Waiver of Jury Trial. The interpretation of these Terms and the resolution of any disputes arising under these Terms shall be governed by the laws of the State of Utah, without regard to its conflict of laws provisions. These Terms shall not be governed by the United Nations Convention on Contract for the International Sale of Goods, the application of which is expressly disclaimed. If any action or other proceeding is brought on or in connection with these Terms, you agree to submit to the personal jurisdiction of the state and federal courts located in the City and County of Salt Lake in the State of Utah, and agree not to bring any action relating to the use of the Sites or these Terms in any court in any other jurisdiction. We will have the right to commence and prosecute any legal or equitable action or proceeding before any US or non-US court of competent jurisdiction to enforce these Terms or to protect our or any third party’s rights in the Sites or the Content. You also agree that we may bring suit in court to enjoin any violation of these Terms without the posting of a bond or security, in addition to whatever remedies we might have at law. In any dispute between you and us where we prevail, we will be entitled to recover reasonable attorney’s fees, court costs, disbursements and other legal expenses. You hereby waive any right to a jury trial.
16. Waiver and Severability. Failure to enforce any provision in these Terms will not constitute a waiver of that provision. If any provision is held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of these Terms will remain in effect.
17. Entire Agreement. These Terms, together with any terms and policies that are incorporated by reference, constitute the entire agreement and supersede any prior agreements between you and us with respect to your use of the Sites and its Content. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

- Account Information includes the information we collect about you when you register for the Services, such as, name, email address, IP address, address - including the location(s) from which you will access the Services, date of birth, account number, last four digits of government identification number, information relating to your hearing loss (including self-certification), age, username, and password. We collect this information when you provide it directly to us. Collection of this information may be used for the purposes of account creation and management, providing our Services, advertising, and marketing, analytics and research, customer service, and website security and maintenance. We also collect this information for compliance with laws, including 47 C.F.R. § 64.611(j), as part of registration for certain Services with the Federal Communications Commission’s User Registration Database.
- Analytics Information includes certain information collected automatically as you navigate our Services. This includes cookies, tracking pixels, tags, or similar tools, which may collect information about your browser, device, geolocation, and interactions with the Services, Site, or emails. For more information, review the “How Do We Use “Cookies” and Other Tracking Technologies?” section below. Collection of this information may be used for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, and website security and maintenance.
- Contact Information includes name, address, phone number, and email address. We collect this information when you provide it directly to us, such as, when signing up for our Services, requesting information, creating an account, or filling out a form. Collection of this information may be used for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, and website security and maintenance.
- Commercial History includes information regarding your user preferences, purchasing history, dates of service, call information, video relay service/internet protocol caption telephone service provider name, and participation in promotional activities only as allowed by law. Collection of this information may be used for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, and website security and maintenance.
- Chat Information includes the contents of chats you initiate with the Site’s chat services. If you interact with the chat services, we will record the conversation. Information relating to your communications may be shared with our service provider. We collect this information for the purposes of account creation and management, customer service, and website security and maintenance.
- Payment Information includes name, address, phone number, and debit or credit card information. We, or our service providers, may collect this information for the purposes of account creation and management, analytics and research, customer service, and website security and maintenance.
- Responses to Surveys and Questionnaires includes any information you provide to us when you voluntarily respond to market research surveys such as email address, age, or products for which you have indicated an interest. We collect this information for the purposes of advertising and marketing, analytics and research, customer service, and website security and maintenance.
- Social Media Information includes information you post by sharing on a public website or another social media platform. We collect this information when you provide it directly to us. Your comments will be visible to the public, so you should never share personal information you would like to keep private. We collect this information for the purposes of advertising and marketing, analytics and research, customer service, and website security and maintenance.
- User-Generated Content. If you post, upload, comment, or otherwise submit content on the Services, we may collect certain information about you such as your name and email address and products you may have used. Be aware that as a default, any information you post on the Services, including without limitation review, comments, and text, may be available to and searchable by all users of the Services. We collect this information for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, and website security and maintenance.
- Customer Proprietary Network Information (“CPNI”): We collect and maintain certain customer proprietary network information (“CPNI”) in accordance with the rules and regulations of the Federal Communications Commission. CPNI includes the types of services you currently receive and related usage and billing information for those services. This information is needed for us to provide you with our services and to seek compensation for our services from the Telecommunications Relay Services Fund. This information will be used to assess and improve our Products and Services. Your telephone number, name, and address are not CPNI. We do not sell, trade, or share your CPNI except as authorized by you or required by law. Generally, and not exclusively, we can use your CPNI without your approval to offer additional, related services to you, and for billing and collections purposes. We require your approval to market unrelated services to you, which we would seek via electronic methods. Before doing so, we will provide you notice of your right to restrict use and disclosure of, and access to, your CPNI. In addition, we can disclose your CPNI without your prior knowledge or consent for legal or regulatory reasons, including in response to subpoenas and court orders. We can also use CPNI to investigate fraud and to prevent violation of our Terms, Conditions, and Acceptable use Policies and unlawful use of our network and services. To use your CPNI for other reasons not set out in this Section we will provide you the option to “opt-out” or “opt-in” to such uses and disclosures. Generally, we may obtain your consent after providing notification through oral, written, or electronic methods.
Our services may require automated speech-recognition systems and individuals, including our representatives and agents, to process, listen to, and transcribe the incoming audio portion (one side) of your telephone conversations. To do this, the incoming audio portion of your telephone call audio will be transmitted to us, or our third-party contractors, for transcription and captioning. To protect your privacy, neither the audio transmission nor transcription of the call will be retained by us or our third-party contractors. By using our services, you agree to the transmission of the incoming audio portion of your telephone call audio to us or our agents and waive any rights you may have under applicable law restricting the same. To the extent permitted by law, you waive all privacy laws governing telephone communications and monitoring of the same. We provide telecommunications relay services, which are regulated by the FCC and will comply with the applicable FCC regulations. To the extent that any consent to disclosure of customer information set forth above in this Section is inconsistent with Sorenson’s obligations under applicable law with respect to protecting, storing, and using customer proprietary network information, we will adhere to the requirements of applicable law.

The following chart identifies the purposes for which we may collect your personal information, as well as information regarding our use and disclosure of that personal information. We may not collect each category of information about each user of our Services.

We also reserve the right to collect, use, or share personal information for the following purposes:
- For Legal Purposes. We reserve the right to cooperate with local, provincial, state, federal, and international officials in any investigation requiring either personal information or reports about lawful or unlawful user activity on this site. We also reserve the right to share your personal information to establish, exercise, or defend our legal and property rights, including providing information to others for the purposes of fraud prevention. We may also share your personal information with any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure. Additionally, we will share some or all of your personal information with government agencies and private entities responsible for administering the Telecommunications Relay Services (TRS) Fund and verifying eligibility for certain Services. If we are ordered by a legal process or government to provide data about one or more individual users, we will notify those users of our compliance with that order, to the extent permitted by law.
- To Present the Site. We may use personal information to present our Site and its contents in a suitable and effective manner for you and your device.
- To Provide the Services. We may use personal information to provide the Services, including to improve operations and for security purposes.
- Customer Service. We may use your personal information to provide you with customer service, troubleshoot issues, and respond to requests, questions, or comments.
- Provide Information and Opportunities. We may use your personal information to advertise opportunities, promotions, products, events, or Services we think may be of interest to you.
- Business Transactions or Mergers. We reserve the right to share your personal information with third parties as part of any potential business or asset sale, merger, acquisition, investment, round of funding, or similar type of transaction. Additionally, if we are entering into a corporate transaction with a third party, we may receive personal information in connection with the diligence. If we close a transaction, the third party may transfer personal information, which we would use as described in this Policy.
- Bankruptcy or Insolvency. In the event of bankruptcy, insolvency, or dissolution proceedings, we may share your personal information with third parties as part of the sale or reorganization process.
- Information From Our Partners. We may collect information from our partners, our affiliates, subsidiaries, joint ventures, or other companies under common control. We may combine that information with other information we collect about you, but we will always use the information as described in this Policy. We may also share information with our affiliates, subsidiaries, joint ventures, or other companies under common control.
3. How Do We Use “Cookies” and Other Tracking Technologies?

Sensitive Information
Sensitive Data as defined in the CTDPA, UCPA, and VCDPA includes precise geolocation information. For the purposes of serving you relevant advertisements based on your location, we collect geolocation information to perform geofencing. We will not collect this information from Connecticut and Virginia residents without first obtaining consent. We will not collect this information from Utah residents without first presenting them with clear notice and an opportunity to opt out of the processing.
Exercising Your Rights
If you are a Colorado, Connecticut, Virginia, or Utah resident and wish to exercise one of the above rights and it applies to you, please visit our “Make a Data Subject Request” page or our “Your Privacy Choices” page.
If necessary, we may request additional information reasonably necessary to authenticate you and your request.
In certain circumstances, you may make a request on behalf of another, such as if you are an authorized agent or the parent or guardian of a child on behalf of whom you wish to exercise their rights.
We will respond to these consumer requests, if applicable, within 45 days of receipt of the request and without undue delay. If we need to extend this period, we will notify you of the delay and explain the reasonably necessary justifications for our delay.
We will provide responses to your requests free of charge unless certain exclusions apply, depending on the state in which you reside. We may charge a fee in:
Colorado, Connecticut, and Utah if you make more than one request in a twelve-month period; and

Where requests are repetitive or manifestly unfounded or excessive, we may charge a reasonable fee based on administrative cost.
Asking us to correct your personal information
You have the right to ask us to correct information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Asking us to delete your personal information
You have the right to ask us to erase your personal information if:
- We no longer need it for the purposes for which we collected it;
- We have been using it with no valid legal basis;

Legal Bases for Processing Your Personal Information
Sorenson collects your personal information to provide our products and Services to you; otherwise, we may not be able to process the transactions you request. We will only process your personal information when we have a lawful basis for doing so. If you are in a country in the EU, EEA, UK, or Switzerland, you are entitled to an explanation of the legal bases we rely on to process your personal information. The legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it, which is discussed below.
- Consent. We may process your personal information based on your consent such as when you purchase a service or ask us to send you certain kinds of marketing communications. You have the right to withdraw your consent at any time without affecting the lawfulness of the processing based on consent before its withdrawal.
- Children’s Consent. We do not knowingly process data of EU, EEA, UK, or Swiss residents under the age of 16 without verified parental consent.
- Our Legitimate Interests. 9. How Long We Keep Your Personal Information (Data Retention or Retention Policy)
We will retain your personal information until the personal information is no longer necessary to accomplish the purpose for which it was provided. We may retain your personal information for longer periods for specific purposes to the extent that we are obligated to do so in accordance with applicable laws and regulations, to protect you, other people, and us from fraud, abuse, unauthorized access, as necessary to protect our legal rights, or for certain business requirements.
We will delete your personal information when it is no longer necessary for the purpose for which it was collected, or upon your request, subject to exceptions as discussed in this Statement or under applicable law, contract, or regulation.
If you use our mobile application, you can delete your account by submitting a request to [email protected] or by deleting your account through the application. If you delete your account from within the application, we will delete the accompanying personal data subject to legal and contractual requirements.

13. Children’s Privacy
Collection of Children’s Information. Protecting the privacy of the very young is especially important. Some of our Services are intended for children under 13 years of age, but note that the Site is not intended for children under 13. Sorenson may also share your child’s name, image (if your child uploads an image), and video phone number(s) with other Sorenson users in your child’s contact list. Sorenson may also share information about your child’s location with emergency services if your child calls 911 from a mobile device enabled with the Services.
Your Choices About Your Child’s Information. You have control over the ongoing collection, use, and disclosure of your child’s personal information. You may also request deletion of your child’s personal information at any time. Solicitudes de eliminación de su información personal
Tiene derecho a solicitarnos que borremos su información personal cuando:
- Ya no la necesitemos para los fines para los que lo recopilamos;
- La hayamos usado sin base legal válida;
- Estemos obligados a borrarla para cumplir con una obligación legal a la que estamos sujetos;
- Necesitemos su consentimiento para usar la información y usted retire el consentimiento; o

Any such use, including by “dialing around” your default VRS provider, is governed by the following disclaimer (this “Disclaimer”).
ADVISORY REGARDING 10-DIGIT NUMBERS AND 911 CALLS
You may request one or more ten-digit telephone number(s) in conjunction with your use of Sorenson VRS, provided you have a medically recognized hearing or speech disability. By obtaining one or more telephone number(s) from Sorenson, you are selecting Sorenson as your “default” provider of VRS. This means that all VRS calls to and from your ten-digit telephone number(s) will be routed, by default, though Sorenson VRS.
Sorenson offers functionally equivalent local ten-digit numbers indicating the geographic location, or “area code,” where a user lives or works. If you would like to request one or more ten-digit numbers, call Sorenson at 866-756-6729 or apply online at https://sorenson.com/vrs/ntouch/.
As your default provider, Sorenson must comply with various legal requirements. Pursuant to these requirements, Sorenson will (i) obtain from you the physical location from which you will access Sorenson VRS (also known as your “Registered Location”); (ii) give you an easy way to update your Registered Location information if it changes, without cost or additional equipment; and (iii) route all emergency 911 calls placed by you via Sorenson VRS to the appropriate emergency personnel and transmit the call-back number and other required information to the emergency response center. You also have the following rights: (i) you may obtain a local ten-digit telephone number from, and register with, your provider of choice (notwithstanding any prior relationship you may have had with another provider); (ii) you may change default providers at any time and, in doing so, retain your local ten-digit telephone number by transferring (or “porting”) the number to the new default provider; and (iii) you may make calls through, and receive calls from, any provider (you are not limited to making or receiving calls through your default provider). In addition, a provider cannot condition the ongoing use or possession of equipment on your continuing to use the provider as your default provider.
If you already have a local ten-digit telephone number from a VRS or IP-based Relay provider other than Sorenson, but would like to select Sorenson as your default provider, you may port your telephone number to Sorenson. To do so, please contact Sorenson by calling 866-756-6729 or by sending an email to [email protected]. You also may port the local ten-digit number(s) assigned by Sorenson to a default provider other than Sorenson. Upon request, Sorenson will port the local ten-digit number assigned to the Videophone to the new default provider.
You can place an emergency call by dialing 911 using Sorenson VRS accessed via your computer, another device (such as a smartphone), or videophone. To ensure that your 911 call is routed to the right emergency response center and that the emergency response center knows where to send assistance, your default provider needs to know the physical address (i.e., the Registered Location) from which you are placing the call. If you have chosen Sorenson as your default provider, it is critical that you inform Sorenson of your Registered Location and immediately notify Sorenson of any subsequent changes to your Registered Location. For example, if you are planning to move to a new address where you will use Sorenson as your default provider to place VRS and/or IP-based Relay calls, you must register that new location with Sorenson. Please note that it can take several hours or, in some cases (e.g., if there is an error in your Registered Location), longer to update your Registered Location so that your 911 call will be routed to the emergency authority serving your location. You can inform Sorenson of your initial or new Registered Location by visiting www.sorensonvrs.com/moving or calling 866-756-6729 from your Sorenson videophone or software. Sorenson will confirm receipt of your Registered Location or any updates to it that you submit to Sorenson. If you move to a new address, or otherwise move your Sorenson videophone to a different physical address such as your office without having given Sorenson sufficient advance notice, any 911 call you make using Sorenson VRS may be directed to the wrong emergency authority or may transmit the wrong address.

Specifically, Sorenson is not liable in tort, contract, or otherwise for any personal injury, property damage, death, or other harm arising out of or related to use of its IP-based Relay Services to make a 911 call, or the provision of any IP-based, video remote, or in-person interpreting services incidental to or in conjunction with such a call, including but not limited to an act or omission involving (1) the development, design, installation, operation, maintenance, performance, or provision of any equipment, software, or facility that permits you to use Sorenson’s IP-based Relay Services, or any IP-based, video remote, or in-person interpreting services provided in connection with a 911 call or the provision of emergency services; (2) misinterpretation, mistakes, interruptions, delays, transmission errors, network outages, failures, defects, technical difficulties, acts of God, or other occurrences, regardless of the source of the occurrence, that may arise in the course of transmitting or handling 911 calls or providing emergency services; or (3) release to a public safety answering point, designated statewide default answering point, appropriate local emergency authority, emergency medical service provider or emergency dispatch provider, public safety, fire service or law enforcement official, or hospital emergency or trauma care facility of user information related to 911 calls or the provision of emergency services. In addition, Sorenson is not liable for any damages arising from your failure to provide Sorenson an accurate, up-to-date Registered Location. For information about how to update your Registered Location, please refer to the Advisory section above.
Furthermore, consistent with Federal law, Sorenson in its role as an emergency communications service provider, shall have immunity or other protection from liability in a State of a scope and extent that is not less than the scope and extent of immunity or other protection from liability accorded any local exchange company under Federal and applicable State law (whether through statute, judicial decision, tariffs filed by such local exchange company, or otherwise).
NOTICE OF LIMITATIONS FOR 911 CALLS
Even though you have selected Sorenson as your default provider, you may make and receive IP- based Relay Services calls, including 911 calls, using any provider. If, however, you have chosen Sorenson as your default provider but place a 911 call through an IP-based relay provider other than Sorenson, Sorenson will have no control over the way the other provider will handle, process, or route the call. Sorenson thus cannot ensure that the other provider will handle the call in accordance with the FCC’s emergency calling rules, or that the call and your location will be automatically routed to the appropriate emergency personnel.
If you use Sorenson’s IP-based Relay Services to place a 911 call, you should be aware that any such use is subject to significant limitations and risks, including but not limited to the following:
First, Sorenson may not automatically be able to obtain your location information or route your call to the appropriate emergency personnel if (i) you use Sorenson’s IP-based Relay Services to place a 911 call, and you have not provided Sorenson an up-to-date Registered Location; (ii) you have not chosen Sorenson as your default provider; or (iii) your Registered Location is not served by the Wireline E911 network or is not available to Sorenson. Furthermore, in these circumstances, if you are incapacitated or otherwise unable or unwilling to give the Sorenson interpreter your address, Sorenson may not be able to obtain your location information and give it to appropriate emergency personnel, although Sorenson will use its best efforts to do so.
Second, even if you have provided Sorenson an up-to-date Registered Location, it can take several hours or, in some cases (e.g., if there is an error in your Registered Location), longer to update your Registered Location so that your 911 call will be routed to the emergency authority serving your location. If you place a 911 call from an address before activation of 911 service for that address, Sorenson may not automatically be able to obtain your location information and/or route your call to the appropriate emergency personnel.
Third, you may not be able to place a 911 call if your videophone or other equipment and/or software provided to or used by you fails to function.
Fourth, you may not be able to use Sorenson’s IP-based Relay Services to place a 911 call if an act beyond our control (including an act of God) has occurred, including one or more of the following:
- a broadband network outage or power outage has occurred, or Internet service has been degraded for another reason, including, but not limited to, congestion, interruptions, or technical problems that may affect your ability to access the Internet;
- your broadband or internet service has been canceled, suspended or terminated for any reason (including for failure to pay); or
- your use of relay service equipment, including Sorenson videophones and/or software, has been terminated, suspended, restricted, canceled, or disabled.
Fifth, 911/E911 is available only for calls placed from a location within the United States or one of its territories or possessions.
Sixth, if you use a Sorenson videophone and/or Sorenson software to place a 911 call through an IP-based Relay Service provider other than Sorenson, Sorenson will have no control over the way the other provider will handle, process, or route the call. Sorenson thus cannot ensure that the other provider will handle the call in accordance with the FCC’s emergency calling rules or that the call and your location will be automatically routed to the appropriate emergency personnel.
Sorenson will not be liable for any cost or damage arising either directly or indirectly from (i) your failure to accept the limitations expressed in this Disclaimer, including your use or misuse of Sorenson’s IP-based Relay Services, (ii) the porting of the telephone number(s) assigned to you to a default provider other than Sorenson, or
(iii) Sorenson’s termination, suspension, restriction, or cancellation of your use of its IP-based Relay Services, and/or Sorenson’s retrieval or disabling of its videophone and/or software. In no event shall Sorenson, its employees, shareholders, officers, or directors, be liable for punitive, reliance, or special damages, or for indirect or consequential damages, including but not limited to lost profits or revenue or increased costs of operation.
These limitations apply even if the damages are foreseeable or we are told they are possible, and these limitations apply to any negligence claim that does not involve willful misconduct or intentional misconduct no matter how that claim is styled or on what legal grounds (such as contract, tort, statute, misrepresentation) it is based.
Sorenson will be liable for no more than the amount of actual direct damages to the person or property.
Except as expressly provided in this Disclaimer, and then only to the extent provided, Sorenson makes no warranties or representations of any kind regarding its IP-based Relay Services.
SORENSON DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Sorenson
disclaims any and all warranties of quiet enjoyment, performance, and non-infringement. Sorenson also makes no warranty that its IP-based Relay Services will be error free or provide uninterrupted service or functionality.
Sorenson shall not be liable for any consequential or incidental damages. Sorenson does not authorize anyone, including, but not limited to, Sorenson’s employees, independent contractors, agents or representatives, to make a warranty of any kind on Sorenson’s behalf and you should not rely on any such statement.
CALLS INVOLVING MEDICAL, MENTAL HEALTH, OR LEGAL ISSUES
When a Sorenson interpreter is interpreting an IP-based Relay Service call, he or she is doing so pursuant to federal law. Specifically, Sorenson’s provision of telecommunications relay services is governed by section 225 of the Communications Act of 1934, as amended, and applicable rules and orders adopted by the Federal Communications Commission. Accordingly, Sorenson cannot and does not represent, warrant, or guarantee that Sorenson’s IP-based Relay Services will meet any requirements mandated by the laws of any state or locality. For example, the role of an in-person interpreter in a legal setting varies from state to state, and may include additional responsibilities including interceding on behalf of the court, the client, or counsel to help ensure that the parties are accurately comprehending the proceeding; attesting to their ability to accurately interpret the legal proceeding; being placed under oath; and being obligated to evaluate an assignment to determine if they are qualified and to refuse the assignment if they feel they are not appropriately qualified to interpret. Sorenson’s IP- based Relay Service interpreters are not subject to such requirements. Moreover, federal law generally prohibits Sorenson IP-based Relay Service interpreters from revealing the content or existence of a telecommunications relay service call, even when doing so would be inconsistent with state or local laws. As a result, a Sorenson IP- based Relay Service interpreter may not be required pursuant to state or local law to testify in court about a relayed conversation.
Consistent with the rules of the Federal Communications Commission, Sorenson employs only qualified interpreters who are capable of interpreting effectively, accurately, and impartially, both receptively and expressively, using any necessary specialized vocabulary. Sorenson, however, cannot and does not represent, warrant, or guarantee that its relay interpreters meet the various interpreting requirements mandated by the laws of any states, or that its interpreters are trained, authorized, or certified to provide IP-based Relay Services pertaining to any particular area of expertise, including medical, mental health, or legal.
EFFECT OF END USER LICENSE AGREEMENT TERMS, CONDITIONS & ACCEPTABLE USE POLICIES
If a Sorenson videophone and/or software has been assigned to you, your use of that videophone and/or software shall be governed by Sorenson’s applicable END USER LICENSE AGREEMENT TERMS, CONDITIONS & ACCEPTABLE USE POLICIES located at http://www.sorensonvrs.com/eula. In the event of any conflict between the terms and conditions of this Disclaimer and the Service and Product Agreement(s), the Service and Product Agreement(s) shall govern and control.
GOVERNING LAW
This Disclaimer will be governed by the laws of the State of Utah, U.S.A., without regard to its choice of law rules. This governing law provision applies no matter where you reside, or where you use the Sorenson IP-based Relay Services. All actions arising from or pertaining to this Disclaimer and all disputes between the parties shall be initiated, maintained, and resolved in Salt Lake City, in the State of Utah.
CHANGES TO THIS DISCLAIMER
Sorenson will update this Disclaimer if our practices change or if the law requires changes to it. You should review this document regularly for changes, and can easily see if changes have been made by checking the effective date below. The Disclaimer is available for viewing at http://sorenson.com/legal. If you do not agree to the terms of this Disclaimer or any other Sorenson Policy, Disclaimer, or Agreement, you should stop using all Sorenson IP-based Relay Services and products immediately. User Registration Database (URD)
As part of the FCC’s ongoing commitment to strengthen the Video Relay Service program, the Commission ordered the creation of a centralized database of all VRS users called the Telecommunication Relay Service User Registration Database, also known as the TRS-URD.
Individual Registration
The FCC requires that VRS providers collect certain personal information from their VRS customer. This information includes a customer’s (1) full legal name; (2) full residential address; (3) last four digits of their Social Security Number (SSN) or Tribal Identification Number (TIN); and (4) date of birth (DOB).
Failing to provide the required information, or supplying inaccurate information, will result in being the customer being denied video relay service.
The customer’s information is submitted to the TRS-URD and verified for accuracy. If there are any issues with the verification of the name, address, SSN, or DOB, our Customer Care team works with our customers to manually verify their information. This verification may require that we obtain from the customer validation documentation to confirm the validity of the customer’s identity or address. The documentation can include the following document types (a full list can be found on the last page):
- an unexpired driver’s license
- an unexpired States government, military or state issued ID
- a birth certificates
- a current income statement from an employer, paycheck stub, or W-2
- a current Utility bill (telephone, electric, water, gas, or internet)
- a current Bank/Credit Card/Loan Statement
If the customer does not have a social security number or Tribal Identification number, the FCC provides for an alternative process to verify the customer’s identity and address. Sorenson will assist customers through this process.

Enterprise and public videophone registration
The FCC requires the registration of all public and enterprise video phones that are accessible to VRS users outside of the home setting. VRS providers are required to gather and submit the following information for registration into the TRS-URD:
- Name of the organization, business, or agency (“Entity”) where the videophone is located
- Physical (Headquarter) address of the Entity
- Registered Location of the videophone
- Whether the videophone is a public or enterprise videophone (47 C.F.R. § 64.601)
- For a videophone indicated as enterprise, the location type where the videophone is located within the Entity.
- Service initiation date
- Name of the individual responsible for the videophone(s) (“Entity POC”)
- Date certification of use was obtained
- Whether or not the videophone is assigned to a hearing individual who knows sign language

The Department of Health and Human Services’ Office for Civil Rights (“OCR”) has issued guidance that specifically addresses whether a Telecommunications Relay Service (“TRS”) Provider, such as CaptionCall is required to enter into a business associate agreement with a health care provider or other HIPAA covered entity. OCR has concluded that “a business associate contract is not required” when a covered health care provider and a patient communicate through TRS. No business associate agreement is required because the TRS [provider]
CaptionCall also is not a “business associate” when it accepts a certification for a new user. First, the certification generally will be transmitted to CaptionCall pursuant to the express, written consent of the patient, which likely eliminates the need for a business associate agreement. Even if that is not the case, CaptionCall is not receiving patient information or providing service “on behalf of” that provider, nor is it providing services—such as accounting, administrative, or legal work—to the covered provider. Instead, CaptionCall is receiving patient information in order to provide relay services to the patient. Thus, no business associate agreement is required solely because CaptionCall receives a certification from a covered provider.
